This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), which gives effect to the constitutional right of access to information held by private and public bodies. It explains what records Miranda Gerber Art holds, and how you can request access to them.
Miranda Gerber Art is a sole proprietorship operated by Miranda Gerber, offering watercolour and mixed-media art classes, workshops, and original artwork for sale, based in Pretoria East, South Africa.
As a sole proprietor, Miranda Gerber is the Information Officer for the purposes of this manual and PAIA requests.
The South African Human Rights Commission (SAHRC) publishes a guide, as contemplated in section 10 of PAIA, to assist anyone wishing to exercise their rights under the Act. That guide is available from the SAHRC:
The following records are freely available on this website and don't require a PAIA request: class and workshop information, pricing, studio location, gallery of available artwork, these legal pages (Terms & Conditions, Privacy Policy, and this manual), and general contact details.
In the ordinary course of business, Miranda Gerber Art holds records in the following broad categories, some of which may contain personal information about clients or students:
To request access to a record not already publicly available, submit a written request to the Information Officer (contact details in section 3) using the prescribed PAIA request form for private bodies (Form 2), available from the SAHRC or the Information Regulator. Your request should be specific enough to identify the record, and should specify the form of access you'd like (e.g. a copy, or to view the original).
A request fee and, where applicable, an access fee may apply, in line with the fee structure prescribed under PAIA's regulations. We'll let you know the applicable fees, if any, once we've received your request. We aim to respond within the 30-day period prescribed by PAIA, or notify you if an extension is needed.
PAIA allows requests to be refused on specific grounds — most relevantly for a small business, where a record contains another person's personal or private information, or commercially sensitive information, and disclosure isn't otherwise justified or required by law. Any refusal will be explained in writing, along with your remedies.
As a private body, decisions made under this manual aren't subject to an internal appeal. If your request is refused (in full or in part), or you're unhappy with how it was handled, you may apply to court for relief, or lodge a complaint with the Information Regulator:
This manual is published free of charge on this website. A copy can also be requested from the Information Officer using the contact details in section 3.
